On December 21, the Quality Brands Protection Committee of the China Association of Enterprises with Foreign Investment (QBPC) Legal Committee held a workshop on Search for Law & Case and Visibility of litigation. Three lawyers shared their perspectives on search strategies and methods, as well as key aspects of litigation visualization. The workshop was moderated by Amelie Chen, Legal Committee Vice Chair, and was attended by more than 70 QBPC members both on-site and online.
Amelie Chen
Ye Jianmei started with discussing the importance of legal search and providing practical suggestions on how to conduct it effectively. She advised of developing precise search needs and tactics, analyzing and organizing the findings, and constantly modifying and improving the search process. Meanwhile she cited examples to explain how to leverage legal search to solve practical problems in a variety of circumstances, such as new legal challenges, new regulatory developments, and new case releases, etc. Furthermore, she highlighted the importance of case search in legal study and litigation strategy formulaiton especially in IP field, which required all-round search for domestic and international judicial practice. Case search could assist lawyers in determining the court of jurisdiction, formulating the evidence strategy, and developing an effective litigation plan, as well as deeply understanding the specialization and preferences of the presiding judge in order to carry out targeted work in the litigation process. There were numerous search tools available, including databases, search engines, and WeChat official accounts. Finally, when searching for cases, it was critical to consider the legitimacy and accuracy of the cases in order to avoid outdated information.

Subsequently Jiao Chen'en went into detail on how to conduct an effective legal search. In particular, he stressed clarifying the requirements and developing the strategy, which might need several revisions and improvements in the process. Following that, he elaborated on search techniques such as summarizing requirements, highlighting key legal issues, identifying keywords, and modifying and refining search strategies. Furthermore, he explained how to output the search findings in the most appropriate format and how to adjust the content of the report according to different purposes and positions.

Finally, Wang Rongqing introduced the wide application of visualization technologies in litigation. According to him, visualization was not simply a presentation approach but also an embodiment of thinking mode and logical framework. On this basis, he thoroughly introduced how to apply three typical visualization charts, including timing diagrams, flowcharts, and relationship charts for case analysis. He also shared some professional tips on visualization techniques, such as outlining the main points of dispute before creating a visual chart and how to strip away secondary information and simplify the chart in order to present the facts of a case accurately.
